Please read these Terms & Conditions (“Terms”) carefully before using or placing an order through (http://www.ceylongemcy.com) (the “Site”). By accessing or using the Site and/or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. About Us
Gemcy Gems (PVT) LTD sells natural gemstones and related products online from Sri Lanka to domestic and international customers. All sales are subject to these Terms and applicable laws.

2. Orders & Acceptance

1. All orders placed on the Site are offers to purchase under these Terms.

2. Order acceptance occurs when we send an order confirmation email and process payment. We may refuse or cancel orders for any lawful reason (inventory error, suspicious payment, export restriction, or inability to verify identity). Standard e-commerce practice permits sellers to decline orders in such cases.

3. Product Information & Pricing

1. We strive to provide accurate descriptions, images, and specifications. Minor variations in color, size, or weight are normal for natural gemstones and do not constitute defects.

2. Prices shown on the Site are in the currency indicated at checkout and exclude shipping, taxes, duties, and any local import fees unless explicitly stated. We reserve the right to update prices and correct errors. Blue-chip jewelry retailers and marketplaces follow similar disclosure norms.

4. Payment

1. Payment must be made by the methods listed at checkout. For security, card details are processed by third-party payment providers; Gemcy Gems does not store raw card numbers on our servers.

2. Orders may be subject to identity verification and additional checks (especially for high-value purchases) before acceptance. These measures follow industry best practices to reduce fraud and comply with regulatory obligations.

5. Taxes, Duties & Import Fees
International shipments may be subject to customs duties, import taxes, and other charges assessed by the destination country. These are the buyer’s responsibility unless otherwise agreed. We will provide commercial invoices and documentation to assist customs clearance.

6. Shipping & Delivery

1. We ship via reputable couriers. Delivery times are estimates and not guaranteed; delays can occur due to customs, courier operations, or force majeure events.

2. Risk of loss transfers to the buyer upon delivery to the courier (or earlier if otherwise stated). For claims of loss or damage in transit, please retain packaging and notify us immediately so we can assist with insurance/claims. Industry terms specify proof of delivery/shipment requirements.

7. Inspection, Authenticity & Title

1. All gemstones sold are accompanied by stated documentation (certificates or reports) where applicable. We guarantee the authenticity of items we sell; authenticity claims will be handled per our warranty and returns procedures.

2. Title to goods passes to you when we receive full payment and (where applicable) when the item is handed to the carrier, subject to any applicable consumer protection rules.

8. Returns, Refunds & Exchanges
Our Returns & Refund Policy describes eligibility, timeframes, and instructions for returns (domestic and international). By purchasing you agree to follow that Policy. (Refer to site’s Returns & Refund Policy for details.)

9. Warranties & Limitation of Liability

1. We warrant that items sold by Gemcy Gems conform to the descriptions provided at the time of sale. For high-value items, we may require authentication checks on returns/refund claims.

2. Except where required by law, our liability for any loss arising from or related to the sale of goods is limited to the purchase price of the item. We are not liable for indirect, incidental, or consequential damages. This limitation is standard in e-commerce T\&Cs.

10. Prohibited Uses

You may not use the Site for unlawful purposes, including but not limited to: reselling restricted goods to prohibited jurisdictions, attempting to bypass export/import controls, or submitting fraudulent payment information. We may suspend or terminate accounts involved in prohibited activities.

11. Intellectual Property

All content on the Site (text, images, logos, product photos, and designs) is owned or licensed by Gemcy Gems and protected by copyright and other IP laws. You may not copy, reproduce, or use content for commercial purposes without our written permission.

12. Privacy & Data Protection

Your personal data is processed according to our Privacy Policy. We collect and process data necessary to complete orders, comply with legal obligations (tax, customs, AML checks for high-value transactions), and communicate with you. Where applicable for EU/UK customers, we comply with GDPR principles.

13. Fraud Prevention & Compliance

Due to the high value of gemstones and international shipping risks, we may require additional proof of identity, refuse suspicious orders, or hold shipments until verification is complete. These measures protect customers and comply with anti-money-laundering and export control obligations.

14. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (natural disasters, customs actions, strikes, pandemics, courier failures). In such cases, we will notify affected customers and make reasonable efforts to fulfill orders.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Sri Lanka. For consumer purchases, local consumer protection laws that provide greater rights will apply. Parties will first attempt to resolve disputes amicably; where necessary, disputes will be resolved in the courts of Sri Lanka or through agreed alternative dispute resolution channels. Sri Lanka provides consumer complaint mechanisms for e-commerce disputes — customers may use applicable ADR/ODR services.

16. Changes to These Terms

We may revise these Terms from time to time. Material changes will be published on this page with a revised “Last updated” date and, where appropriate, notified to registered customers.
